行政考核中的形式主义法律规制研究

摘要
行政考核存在较严重的形式主义,是我国治理形式主义的重点领域,从法学上思考如何治理形式主义的成果紧缺。基于行政法视角,本文从体制机制、管理手段、程序规定三方面研究行政考核中形式主义产生的制度原因,并提出坚持实绩导向、完善法律规范、听取服务对象意见和评价、完善考核体系和程序性规定等法律规制建议,力图有效整治形式主义,切实提升基层治理效能,推进国家治理能力和治理体系现代化建设。
Abstract
There is a serious formalism in administrative assessment, which is a key area of governance formalism in China. From a legal perspective, there is a shortage of achievements in governing formalism. Based on the perspective of administrative law, this article studies the institutional reasons for the emergence of formalism in administrative assessment from three aspects: institutional mechanisms, management methods, and procedural regulations. It proposes legal regulatory suggestions such as adhering to performance orientation, improving legal norms, listening to the opinions and evaluations of service recipients, improving the assessment system and procedural regulations, and striving to effectively rectify formalism, effectively enhance grassroots governance efficiency, and promote the modernization of national governance capacity and governance system.
