| 摘要 |
随着互联网技术的发达，数据库产业蓬勃发展，数据库因为其超强的容纳能力，使人们在搜集、整理、查询信息时十分方便快捷。但是数据库侵权案件频频发生，数据库制作者和数据库使用者的矛盾突出。这种情况说明我国在数据库的法律保护方面存在很多问题。本文拟从美、德两地的发展经验进行概括的梳理并就其中发生的问题予以评论，以其对国内目前正在推展的相关立法提供参考。

| Abstract |
With the development of Internet technology, the database industry is booming. Because of its super capacity, the database makes it very convenient and fast for people to collect, organize and query information. However, database infringement cases occur frequently, and the contradiction between database producers and database users is prominent. This situation shows that there are many problems in the legal protection of databases in our country. This article intends to summarize the development experience of the United States and Germany, and to comment on the problems that have occurred, so as to provide a reference for the relevant legislation currently being promoted in China.
