摘要
2015年,《中华人民共和国高等教师法》正式修订,并将教师聘任制正式在高等学校进行实施。学校和教师在满足双方平等的条件下签订劳动合同,达成契约关系,这一措施对于我国高校改革有着十分重大的影响,同时也推动了我国高校教育的良好发展。不过聘用制的教师和学校之间发生纠纷的事件常有发生,至今为止,我国所设立的《中华人民共和国教师法》简称《教师法》确实能够在一定程度上维护教师的合法权益,不过目前而言,仍然还是存在很多的不足之处。让聘用制教师的合法权益能够得到有效的维护,我认为就目前的聘用制教师申诉权进行探讨是十分有必要的。
Abstract
In 2015, the Higher Teachers Law of the Peoples Republic of China was officially revised, and the teacher appointment system was officially implemented in colleges and universities. Schools and teachers sign labor contracts and reach a contractual relationship under the conditions of equality between the two parties. This measure has a very significant impact on the reform of colleges and universities in my country, and also promotes the sound development of college education in China. However, disputes between employment-based teachers and schools often occur. So far, the "Teachers Law of the Peoples Republic of China", referred to as the "Teachers Law" established by our country can indeed protect the legitimate rights and interests of teachers to a certain extent, but at present However, there are still many deficiencies. So that the legitimate rights and interests of the employment system teachers can be effectively maintained, I think it is very necessary to discuss the current employment system teachers appeal rights.
