| 摘要 |
商标的描述性正当使用是商标侵权抗辩的主要理由之一，但其规制体系、认定标准并非完备。在规制体系上可借鉴日本商标法的立法经验，将商品和服务中的描述性正当使用加以区分，在认定标准上可将“突出使用“作为否定要素加以考量，借此达到高效发挥此项制度的功能。

| Abstract |
Descriptive fair use of trademarks is one of the main reasons for the defense of trademark infringement, but its regulatory system identification standards are not complete. In terms of the regulatory system, we can learn from the legislative experience of Japanese trademark law to distinguish descriptive fair use of goods and services, and highlight the use of descriptive fair use in the identification standards As a negative factor to consider, so as to achieve efficient play of the systems functions.
