摘要
在互联网技术的迅猛发展、数字经济蓬勃兴起的时代浪潮下,产业结构不断调整升级,灵活就业作为一种新兴的就业模式迅速在劳动力市场中崛起并占据重要地位。与此同时,随着灵活就业人员劳动权益保障缺失、社保难缴纳等问题的涌现,灵活就业人员这个庞大群体的社会保障问题也成为社会关注的热点,本文通过文献分析以及案例分析可知在实践中关于社保如何缴纳存在着诸多不足,故以比例原则的视角下对劳动关系的认定、劳动者与企业就参保的利益冲突等方面的突出问题从不同角度兼顾各方利益来制度设计,以此更好的保障灵活就业群体长期稳定发展。
Abstract
With the rapid development of Internet technology and the booming wave of digital economy, industrial structure is constantly adjusted and upgraded, flexible employment as a new employment mode quickly rises in the labor market and occupies an important position. At the same time, with the emergence of flexible employment workers lack of labor rights and interests protection and difficult payment of social security, the social security problems of flexible employment workers, a huge group, have also become a hot spot of social concern. Through literature analysis and case analysis, it can be seen that there are many shortcomings in practice on how to pay social security, so the prominent problems in the identification of labor relations from the perspective of the principle of proportion, and the conflicts of interest between laborers and enterprises on insurance participation are systematically designed from different perspectives by taking into account the interests of all parties, in order to better ensure the long-term stable development of flexible employment groups.
