| 摘要 |
《中华人民共和国民法典》首次确立居住权制度,赋予其用益物权属性,兼具社会保障与家庭伦理价值。通过遗嘱设立居住权作为法定方式之一,其生效节点与登记效力因法律条文适用冲突引发学界争议。本文基于《民法典》相关条款及司法实践,聚焦遗嘱继承与遗赠两种类型,探讨登记效力的差异化认定,认为应采用灵活应变主义:遗嘱继承设立居住权应遵循“登记宣示主义”,即继承开始时物权即生效,登记仅具公示功能;遗赠方式则适用“登记生效主义”,需经登记程序方产生物权效力。灵活应变主义主张打破“一刀切”模式,通过细分遗嘱方式类型,平衡立法初衷与实务需求,避免“遗产空窗期”风险,契合“定分止争”的法治精神。

| Abstract |
The Civil Code of the Peoples Republic of China established the right of habitation system for the first time, endowing it with the attribute of usufructuary right, and it has both social security and family ethical values. The establishment of a right of habitation through a will, as one of the legal methods, has sparked academic controversy due to conflicts in the application of legal provisions regarding its effective date and registration effect. Based on the relevant provisions of the Civil Code and judicial practice, this article focuses on the two types of testamentary succession and bequetry, explores the differentiated determination of registration validity, and holds that a flexible approach should be adopted: the establishment of the right of habitation through testamentary succession should follow the "registration declaration principle", that is, the property right takes effect at the beginning of the inheritance, and the registration only has the function of public announcement. The bequest method is subject to the "registration validity principle", and it only acquires the effect of real rights after going through the registration process. The flexible and adaptable approach advocates breaking the "one-size-fits-all" model. By subdividing the types of will forms, it strikes a balance between the legislative intent and practical needs, avoiding the risk of a "gap period" in the estate and aligning with the spirit of the rule of law of "settling disputes by dividing the estate".
