| 摘要 |
加强涉外法治人才培养是加强涉外法治建设的关键。应以实践为导向,加大对于国别法和法律实务的学习。案例法的要求是遵循先例,其特征在于先例规则不能脱离先例事实逻辑而存在。实践中争议焦点往往在于判断当下争议事实逻辑与先例的异同,而是否应当遵循某一先例则是判断后的结果。本文认为,在涉外法治人才的教育改革与实践中,应加强学生利用先例对未列明事实的缄默空间进行从宽或从严辩证解读的能力。

| Abstract |
Strengthening the cultivation of foreign-related legal talents is the key to strengthening the construction of foreign-related rule of law. It should be practice-oriented and increase the study of national laws and legal practices. The requirement of case law is to follow precedents, which is characterized by the fact that precedent rules cannot exist independently of the logic of precedent facts. In practice, the focus of disputes often lies in judging the similarities and differences between the logic of the current disputed facts and precedents, and whether a certain precedent should be followed is the result of the judgment. This article believes that in the education reform and practice of foreign-related legal talents, students should be strengthened to use precedents to dialectically interpret the silent space of unlisted facts leniently or strictly.
