| 摘要 |
自改革开放以来，我国的未成年人犯罪刑事政策发生了巨大转变，从“严打”走向“教育”，逐渐认识到未成年人犯罪的本质。近几年来，新闻媒体频繁报道发生的未成年人重大杀人伤人案件，再次引起了学界和社会大众对于未成年人犯罪的热议，从而也引发了对未成年人犯罪刑事政策的反思。从社会道义与功利性的角度来看，“教育为主，惩罚为辅”的刑事政策本身并不存在任何问题，争议的核心在于我国未能形成系统的未成年人刑事法律体系，无全面详细的具体刑事制度支撑“教育为主，惩罚为辅”刑事政策的运行。

| Abstract |
Since the reform and opening up, Chinas juvenile delinquency criminal policy has undergone a huge change, from "strike hard" to "education", gradually realize the nature of juvenile delinquency. In recent years, the news media frequently reported the major murder and wounding cases of minors, again aroused the academic community and the public for juvenile delinquency hot debate, thus also triggered the reflection of juvenile delinquency criminal policy. From the point of view of social moral and utilitarian, the criminal policy of "education is given priority to, punishment is complementary" itself does not exist any problems, the core of the controversy is failed to form a system of minor criminal legal system in China, without the full details of specific criminal system support "education is given priority to, punishment is complementary" the operation of criminal policy.
