摘要
本文探讨的问题是:在涉外法治人才培养中,英美法教育的过程中该多大程度借鉴英美法教育的主流教育方法,即苏格拉底质询法。本文首先回顾苏格拉底质询法诞生的背景和目的,优势与问题,并提出相应的改善措施,本文认为在我国英美法教育的过程中,应将条文法教学与苏格拉底质询法的优势进行结合。同时在案件的选取上有别于英美本土法学院的,让学生的教育过程符合教育规律,保护学生的自信心和获得感,另外,本文认为应将苏格拉底质询法的对抗氛围适度弱化,更符合中国社会文化以和为贵的文化氛围。
Abstract
This essay attempts to answer the following question: in the process of cultivating foreign-related law professionals, to what extent shall teachers of common law courses at Chinese law schools adopt the Socratic method, the dominant pedagogy of US law schools? This essay first traces back the origin and purpose of the Socratic method, its advantages and disadvantages. This essay argues that the teachers should combine the advantages of statutory teaching and socratic method. Furthermore, the selection of cases should differ in Chinese law schools as compared to their couterparts in US law schools, for the dual purpose of increasing students understanding and protecting students confidence. Moreover, this essay argues for a decrease in antagonism inherent in the Socratic method, to make the method more adaptable to the Chinese cultural environment emphasizing peace and harmony.
